PREVENTO HEALTH TECH SOLUTIONS PRIVATE LIMITED, a private limited company in India and having its registered office at 1-57/182, First Floor, Block B, Sri Ram Nagar Colony, Kondapur, Hyderabad, Telangana-500084 (hereinafter referred to as “We”, “Us”, “Company” or “Our”). PREVENTO HEALTH TECH SOLUTIONS PRIVATE LIMITED is the sole owner of the Heart Saver Mobile Application and Heart Saver Services. PREVENTO HEALTH TECH SOLUTIONS PRIVATE LIMITED is concerned about the privacy of the users (hereinafter referred to as “You”, “Your” or “User”) of its Heart Saver Mobile Application and Heart Saver Services. The Heart Saver App is part of the Heart Saver Service (“the Service)” which is a subscription-based healthcare service that helps customer manage situations arising out of suspected Heart Attack and medical emergency situations arising as a result of Heart Attack and Sudden Cardiac Arrest. The ECG device, AED (Automated External Defibrillator), ECG reporting and other services, information, materials, devices and products we provide to you and described herein are each individually or collectively referred to as “Service” or “Heart Saver Service”.

Your privacy is important to Us and We strive to take reasonable care in the protection of the information We receive from you. We therefore provide this privacy policy statement (the “Privacy Policy”) to familiarize You with the manner in which the Company collects, uses and discloses Your information collected through the mobile application.

By clicking on the “I accept’ button at the end of page You hereby consent to the collection, storage, and processing of any or all of Your Information, as well as sharing and transfer of Your Information by Heart Saver to its third-party vendors as specified under this Policy. You acknowledge that You are providing Your Information out of Your free will.

You will have the option to not provide your consent, or withdraw any consent given earlier, provided that the decision to not provide consent / withdrawal of the consent is intimated to Us in writing as per the contact information provided in this Policy. If You do not provide Us Information or withdraw the consent to provide Us with any of Your Information at any point in time, We shall have the option not to provide the benefits for the purpose of which the said Information was sought.

2)     Definitions

2.1   “Personal Information” is data collected that can be used to uniquely identify or contact You. Personal Information for the purposes of this Policy may include Your name, address, telephone number, date of birth, gender, e-mail address, GPS based location, and iOS device ID/Google Advertising ID/Android ID.

2.2   “Sensitive Personal Data or Information” or “SPDI” is the Personal Information that consists of data relating to Your billing information (e.g., credit or debit card numbers), physical, physiological and mental health condition, and medical records and history (e.g., social security number, healthcare information).

3)     Collection of Your Information

3.1   Heart Saver collects Your Personal Information and Sensitive Personal Data or Information (collectively  “Information”) in various ways, which include (a) direct collection of the information from You, (b) through the Heart Saver mobile application server logs and app cookies during the course of You availing the services on the mobile application and (c) indirect collection through your residential communities, your workplace or business organization and medical devices.

3.2   By accessing or using our mobile application, You expressly consent to such collection, as required under applicable law. You may choose not to assent to Our Policy.

4)     Purpose for Collection of Your Information

4.1    Information will be processed by Heart Saver for the purposes of providing services set out in agreement with the customer. Any additional processing of Information will require to be approved by You prior to such processing. Typically, the purpose of the processing of the Information is:

a.     To deliver Heart Saver services through Our mobile application and other products. We also use the information We collect to customize our services for You, including providing recommendations, personalized content.

b.     We use the Information collected to help Us develop new services and products.

c.      Medical Interpretation of Echocardiogram (ECG), and other diagnostic tests.

d.     Digital Platform for healthcare care providers coordinates with each other for a case. This coordination involves sharing information via video, images, information, and chat.

4.2    We also use the Information to verify that only authorized users are accessing the respective application; to build Your electronic client record or electronic personal health record so that Heart Saver may provide you the specific personalized service You have applied for and agreed with; and to contact You when necessary, to communicate helpful tips and advice during Your participation to this service.

4.3    We also use Your Information and any associated metadata for internal purposes, and the Information may be subjected to the Algorithms and Cloud Storage, as needed, for purposes including but not limited to storing the data during and after the service is delivered.

4.4    Heart Saver will only process Information that is required to fulfill its contractual obligation and render appropriate services.

5)     Sharing your Information

5.1    Heart Saver may transfer, share, part with all or any of Your Information for one or more of the Purposes or as may be required by applicable law (including laws outside Your country of residence) with the Company’s affiliates / agents / public and government authorities / third party service providers / partners / banks and financial institutions. You acknowledge and consent to transfers of Your Information.

5.2    Heart Saver may transfer, share, part with all or any of Your Information to comply with legal process / enforce Our Terms of Use / protect Our operations or those of any of Our affiliates / protect Our rights, and/or that of Our affiliates, You or others / allow Us to pursue available remedies or limit the damages that We may sustain.

5.3    Heart Saver contractually ensures that the recipients of your Information have at least the same level of security practices in place to protect your Information.

6)     Links to third party websites

6.1    The mobile application may have links to third-party advertisements and third-party websites, which are operated by third parties and are not controlled by Heart Saver unless expressly specified on the mobile application. Heart Saver does not provide any of Your Information to these third-party websites or advertisers.

6.2    Heart Saver is not responsible for any form of transmission, whatsoever, received by You from any third-party website. Accordingly, Heart Saver does not control or guarantee the accuracy, integrity, or quality of the content available on such third-party websites. The Information provided by You to such third-party websites shall be governed in accordance with the privacy policies of such third-party websites and it is recommended that You review the privacy policy of such third-party websites prior to using such websites.

6.3    You acknowledge and agree that We are not responsible for any collection or disclosure of your Information by any external sites, applications, companies or persons, nor do We endorse any advertising, products or other material on or available from such external applications, websites or resources.

6.4    You further acknowledge and agree that We are not liable for any loss or damage which may be incurred by You as a result of the collection and/or disclosure of Your Information by external applications, sites or resources, or as a result of any reliance placed by You on the completeness, accuracy or existence of any advertising, products or other materials on, or available from such applications, websites or resources. These destination links are provided only for your convenience, and as such, you access them at your own risk.

7)     Security

        7.1    The security of Your Information is important to us. Heart Saver strives to ensure the security, integrity and privacy of Your Information and to protect Your Information against unauthorized access or unauthorized alteration, disclosure or destruction.

        7.2    For this purpose, Heart Saver implements and maintains appropriate technical and organizational security measures to protect Your Information and to preserve the security and confidentiality of such Information in accordance with Heart Saver’s security standards.

        7.4    While We will endeavor to take all reasonable and appropriate steps to keep secure any information which We hold about You and prevent unauthorized access, You acknowledge that no electronic medium / security measure is 100% secure and that We cannot provide any absolute assurance regarding the security of your Information. We are not responsible for any breach of security or for any actions of any third parties that receive Your Information. Heart Saver is not liable for any loss or injury caused to You as a result of You providing Your Information to third party websites, even if links to such third-party websites are provided on our mobile application.

8)     Choice to Opt-Out/Correction

        8.1    You have the right to access and correct/amend any inaccurate or deficient Personal Information or SPDI.

        8.2    You may deny or withdraw consent for the collection and processing of Your Information under this Policy. If You deny or withdraw Your consent, You may not be able to access our mobile application and receive Our services.

        8.3    Heart Saver provides you with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from Us or on behalf of Our partners after setting up an Account.

        8.4    If You wish to exercise the above actions, please write to us at contact@heartsaver.in with “Discontinue” as the subject.

9)     Retention of Information

        9.1    Heart Saver will not process Information when the purpose for which the data was collected is not being served any longer. Upon request from the customer, Heart Saver will destroy Information in its possession unless it is required to be retained by law.

        9.2    Heart Saver reserves the right to make use of de- identified data in perpetuity, as per the terms laid out in HEART SAVER TERMS OF USE.

10)   Disclaimer

        10.1  The terms in this agreement may be changed by the Company at any time.

        10.2  By registering for or by using our mobile application, You explicitly accept, without limitation or qualification, the collection, use and transfer of the Information provided by you in the manner described in this Privacy Policy.

        10.3  Please read this Privacy Policy carefully as it affects your rights and liabilities under law. If You do not accept the Privacy Policy stated herein or disagree with the way We collect and process Information collected on the mobile application, please do not use it.
